Pelosi facing increasing pressure to support impeaching Trump
House Speaker Nancy Pelosi is scheduled to have a special caucus-wide meeting of House Democrats on Wednesday morning as she faces growing calls within her party to impeach President Trump. Prior meetings involving Pelosi and top Democrats have escalated into heated exchanges, with the party torn over how to address Trump See More controversies. Pelosi has been reluctant to support impeachingTrump and has warned Democrats that impeachment could distract from the focus needed to win in the 2020 presidential election.

The House speaker has also warned colleagues that voters may not support impeaching Trump and that the party could suffer voter backlash if Trump was ultimately acquitted in the Republican-led Senate. Still, former White House counselDonald McGahn’s refusal, on Trump’s orders, to appear at a hearing before the House Judiciary Committee on Tuesday has escalated tension between congressional Democrats and the Trump administration. A growing number of Democrats say they are dealing with a “lawless president” and that impeachment, not numerous investigations, may be the only way to hold the president accountable.

Joe Frontrunner versus ‘Crazy Uncle Joe’ 
Joe Biden might be leading the race for his party’s nomination now, but the former vice president is a “walking time bomb” and has to perform a “high-wire act” if he is to emerge from the crowded Democratic field in first place, according to Brit Hume, Fox News’ senior political analyst. “I like Biden on a personal basis, but I think he is a walking time bomb,” Hume said. “I think his age is an issue, I’m the same age as he is, my age is an issue, I think his is too… the filters don’t work as well, the memory isn’t as sharp. Hume made the comment while discussing Biden’s 2020 prospects on the latest episode of the Fox News podcast, “The Candidates with Bret Baier.”

Dozens of tornadoes slam the Midwest
Dozens of storms and tornadoes in the Midwest on Tuesday damaged multiple buildings — including a racetrack grandstand –but were expected to weaken by Wednesday. Missouri and parts of Illinois already have been hit with severe weather in the second consecutive day of severe storms and were blamed for at least two deaths. St. Louis was largely spared from the powerful stormsystem, but baseball’s St. Louis Cardinals called off their Tuesday game against their cross-state rivals, the Kansas City Royals, as the rumbling of an approaching storm could be heard downtown. The city’s Lambert Airport shut down for an hour Tuesday butresumed flights a short time later.

Beverly Hills tobacco ban advances
The exclusive community of Beverly Hills, Calif., took a step Tuesday toward becoming the first city in the United States to ban the sale of tobacco products. The city council approved an ordinance that would ban the sale of cigarettes, cigars and other tobacco products at all retail locations within the tony Southern California city, including gas stations, convenience stores, pharmacies and newsstands. However, hotels and several high-end cigar lounges — including the Grand Havana Room, Arnold Schwarzenegger’s favorite cigar club – would be exempt from the rule. The second reading and final vote on the ordinance is expected to take place in early June. If passed, the ordinance will be reviewed by the council in three years. Beverly Hills wasn’t the only place to make history Tuesday: Washington state Gov. Jay Inslee signed a bill into law that allows the composting of human bodiesas an alternative to burials and cremations.

Cannes film poster depicts decapitated Trump
A B-movie poster courted controversy at the Cannes Film Festival’s Market by featuring a bikini-clad woman resembling first lady Melania Trump holding two decapitated heads — one of them a President Trump-like character wearing a “Make America Great Again” cap. The poster, for a 90-minute sci-fi thriller called “When Women Rule the World,” featured the tagline: “Meet the first lady of the future with her HEADS OF STATE!” The film was being promoted at the Cannes Market, part of the international film festival held each May in France.

Former White House Counsel McGahn to defy subpoena on Trump’s orders, threatened with contempt by House Dems
House Judiciary Committee Chairman Jerry Nadler, D-N.Y., says he will hold former White House counsel Donald McGahn in contempt after McGahn said he would not appear See More at a hearing scheduled for Tuesday. President Trump directed McGahn to skip the hearing, citing a Justice Department opinion that he cannot be compelled to testify about his official duties.

The White House has accused Democrats of wanting a “do-over” with countless Trump investigations following the findings of no collusion in Special Counsel Robert Mueller’s investigation. A frustrated Nadler on CNN accused the White House of “intimidating” McGahn and said it was becoming “more and more difficult” to not consider impeachmentagainst “a lawless president.” And despite her reluctance, House Speaker Nancy Pelosi could soon be left with no choice but to embrace calls from some within her party to impeach Trump, one senior Democrat told Fox News on the condition of anonymity.

Lynch versus Comey
Former Attorney General Loretta Lynch has flatly accused former FBI Director James Comey of mischaracterizing her statementsby repeatedly alleging, under oath, that Lynch privately instructed him to call the Hillary Clinton email probe a “matter” instead of an “investigation.” Lynch, who testified that Comey’s claim left her “quite surprised,” made the dramatic remarks at a joint closed-door session of the House Oversight and Judiciary Committees last December. A transcript of her testimony was released on Monday by House Judiciary Committee ranking member Doug Collins, R-Ga.

All eyes on Iran’s uranium
Iran quadrupled its uranium-enrichment production capacity amid tensions with the U.S. over Tehran’s atomic program, nuclear officials said Monday, just after President Trump and Iran’s foreign minister traded threats and taunts on Twitter. Iranian officials made a point to stress that the uranium would be enriched only to the 3.67 percent limit set under the 2015 nuclear deal with world powers, making it usable for a power plant but far below what’s needed for an atomic weapon. But by increasing production, Iran soon will exceed the stockpile limitations set by the accord. Tehran has set a July 7 deadline for Europe to set new terms for the deal, or it will enrich closer to weapons-grade levels. – The Associated Press

Severe storms rip the Southern Plains
A severe storm system that forecasters warned could bring dangerous tornadoes to parts of Texas, Oklahoma and Kansas ripped through the Southern Plains Monday evening, spawning twisters that damaged buildings and produced heavy rain, but caused no reported injuries. The tornadoes that were reported Monday were in sparsely populated areas. Glynadee Edwards, the Greer County (Okla.) emergency management director, told the Associated Press that some homes in the southwestern town of Mangum incurred roof damage and the high school’s agriculture barn was destroyed, but the livestock survived.

Oprah called out for not paying off students’ loan debt
Oprah Winfrey responded Monday to an Instagram user who called out the billionaire mogul for not paying off student loans after her commencement speech at Colorado College, in an apparent comparison to investor Robert Smith’s now-famous gesture at Morehouse College. The Queen of Talk was told that she “should have paid off their student debt,” and swiftly responded, pointing out her multimillion-dollar donations through the years to help university students.

Trump vows to not let Iran get nukes, takes on Biden and Buttigieg in Fox News interview
President Trump vowed, in a wide-ranging interview with Fox News, not to let Iran get nuclear weapons – but reiterated his reluctance to go to war. “I will not let Iran have nuclear See More weapons,” he told Steve Hilton, host of “The Next Revolution.” “I don’t want to fight. But you do have situations like Iran, you can’t let them have nuclear weapons — you just can’t let that happen.” Earlier Sunday, the president tweeted that a war would result in “the official end of Iran” and warned the nation to “[n]ever threaten the United States again!” Trump tweeted hours after a rocket landed less than a mile from the U.S. Embassy in Baghdad’s heavily fortified Green Zone, the first such attack since September.

Tensions between the U.S. and Iran have risen in recent weeks after the Trump administration ordered warships and bombers to the Middle East earlier this month to counter threatened attacks against U.S. interests by Iran or Iranian-backed forces. During his interview, the president also addressed the rising challenge 2020 presidential candidate, South Bend, Ind. Mayor Pete Buttigieg and 2020 Democratic frontrunner Joe Biden’s questionable ties to China and role in the Iran nuclear deal Trump withdrew from last year.

Buttigieg defends appearance on Fox News town hall
Insurgent Democrat presidential candidate Pete Buttigieg acknowledged at the Fox News town hall in Claremont, N.H. Sunday evening that he needs to do more to appeal to “black and brown” voters, even as he parried a series of policy questions — and, on several occasions, went directly after President Trump.

Buttigieg argued that minority voters are “skeptical of people who seem to come out of nowhere,” after moderator Chris Wallace noted that he was polling at one-percent support among nonwhite primary voters according to a recent Fox News poll. Buttigieg also took on the controversial newly passed pro-life legislation passed in Alabama, as well as similar bills making their way through other state legislatures, Trump’s tweets, tax hike proposals and explained his decision, as a Democrat, to appear on a Fox News town hall.

Jimmy Carter – kingmaker, once again
Jimmy Carter appears to again be a kingmaker in the race for the White House. At least three Democratic presidential hopefulshave ventured to the tiny town of Plains, Ga., to meet with Carter, 94, and his wife, Rosalynn,91. Minnesota Sen. Amy Klobuchar, New Jersey Sen. Cory Booker and Mayor Pete Buttigieg of South Bend, Indiana, have visited with the Carters and attended the former president’s Sunday School lesson in Plains. It’s quite a turnabout for a man who largely receded from party politics after his presidency, often without being missed by his party’s leaders in Washington, where he was an outsider even as a White House resident.

Sweden calls for Assange’s detention over alleged rape
A top Swedish prosecutor on Monday formally asked that WikiLeaks founder Julian Assange be detained in absentia over the alleged rape of a woman in her home nearly a decade ago, reports said. The move was seen as the first step in his possible extradition from Britain. The Australian also faces a U.S. extradition warrant for allegedly conspiring to hack into a Pentagon computer.

A merciful ‘Terminator’
Arnold Schwarzenegger announced Sunday that he won’t press charges against the man accused of assaulting him over the weekend. “A lot of you have asked, but I’m not pressing charges,” the 71-year-old “Terminator” star tweeted. “I hope this was a wake-up call, and he gets his life on the right track. But I’m moving on and I’d rather focus on the thousands of great athletes I met at @ArnoldSports Africa.” On Saturday, a video went viral of the former Republican governor of California at an Arnold Classic Africa event in Johannesburg, South Africa, when a man rushed and dropkicked Schwarzenegger from behind.

‘Game of Thrones’ comes to an end – and fans dump on the finale
The much-anticipated series finale of “Game of Thrones” aired on HBO on Sunday and many “GoT” fans were not impressed. Without giving up spoilers (that’s a warning), some fans unhappy with who ultimately wound up on the Iron Throne. Other fans online have called the finale the “worst episode of the entire series.” Some are grouping end of “Thrones” with “The Sopranos” and “Lost” as among the worst TV finales of all time. It looks like a petition demanding that HBO remake the final season “with competent writers” will likely get many, many more signatures.

William Barr speaks out in Fox News exclusive; Trump immigration overhaul plan pushback

In an exclusive interview with Fox News, Attorney General William Barr explained that he is trying to get to the bottom of whether or not “government officials abused their power and put their thumb on the scale” during the early stages of the Russia probe. “I’ve been trying to get answers to the questions and I’ve found that a See More lot of the answers have been inadequate and some of the explanations I’ve gotten don’t hang together. In a sense I have more questions today than when I first started,” Barr told Fox News’ Bill Hemmer in an interview set to air Friday on “America’s Newsroom.”

Hemmer conducted the interview with Barr in El Salvador, where he will address the crisis on the U.S.-Mexico border, MS-13, drug trafficking and human trafficking with officials.

New York City Mayor Bill de Blasio announcedThursday that he will seek the Democratic nomination for president in 2020, becoming the 23rd Democrat to officially announce a bid for the White House and the second this week following Montana Gov. Steve Bullock’s announcement on Tuesday. De Blasio took direct aim at President Trump, calling him a “bully,” adding that “I know how to take him on.”

Still, even de Blasio’s hometown was not impressed. A recent Quinnipiac University poll found 76 percent of New York City voters said they believed de Blasio shouldn’t run and gave the mayor “an anemic 42-44 percent job approval rating.” In an editorial, the New York Post called de Blasio’s candidacy a “complete farce” and gave reasons why “why Democrats across America shouldn’t waste time or money on this guy.” Trump called de Blasio “the worst mayor in the US.” And the blast-a-thon on de Blasio will likely go on and on.

Trump unveils immigration overhaul plan
President Trump on Thursday unveiled a long-awaited immigration overhaul that would dramatically alter how the U.S. accepts people into the country, upending the system in order to favor admissions based on merit rather than family ties. The proposal would judge immigrants with a points-based system that would favor high-skilled workers — accounting for age, English proficiency, education and whether the applicant has a well-paying job offer. Rep. Ilhan Omar, D-Minn., warned Trump’s plan would have a “devastating effecton millions of people” and renewed her call to abolish ICE (the federal Immigration and Customs Enforcement agency). Fox News host Laura Ingraham said on “The Ingraham Angle” on Thursday that the plan “makes sense” for America.

California’s high-speed rail project stopped in its tracks
The Trump administration is withdrawing nearly $1 billion in federal money for California’s high-speed rail project. The Federal Railroad Administration announced Thursday it will not give California the $928,620,000 it was originally promised, saying the state “repeatedly failed to comply with the terms” of its grant, “failed to make reasonable progress on the Project,” and “abandoned its original vision” for a train connecting Los Angeles to San Francisco. The administration will also be seeking to recover an additional $2.5 billion in funds from the state that were allocated to the project through the American Recovery and Reinvestment Act, a move that the California Rail Authority pleaded against in March.

It’s ‘GoT’ finale weekend
The series finale of “Game of Thrones” will air on HBO this Sunday and “GoT” fans – enamored and disgruntled alike – will likely give the cable channel blockbuster, perhaps record-setting, ratings. Besides the fates of Jon Snow, Daenerys, Arya and the Iron Throne, there are other questions that will need to be answered: Will more Starbucks cups or other “GoT” editing blunders be noticed by eagle-eyed fans? Will any more NFL quarterbacks make cameo appearances? Will even more viewers join the 350,000-plus disgruntled  faithful who have signed a petition demanding that HBO remake the final season “with competent writers”? Stay tuned.

Trump rips ‘Fake News’ over reports of White House discord on Middle East Policy
President Trump on Wednesday trashed the Washington Post and the New York Times for reporting on alleged White House infighting over the administration’s policy on the Middle East. Trump, in a tweet, denied that there See More was infighting between his staff as tensions escalate with Iran – saying that opinions may differ, but that he is the person who makes the final decisions. “The Fake News Washington Post, and even more Fake News New York Times, are writing stories that there is infighting with respect to my strong policy in the Middle East,” Trump tweeted. “There is no infighting whatsoever.” Trump’s tweets come amid mounting tensions between Washington and Tehran, with the Pentagon on Wednesday ordering all nonessential government staff to leave Iraq amid still-unspecified threats that the Trump administration has linked to Iran. The recent discord between the U.S. and Iran has raised concerns among lawmakers on both sides of the aisle about a potential war with Iran, and has drawn comparisons to the lead-up to the Iraq War in 2003.

Who is John Durham? Prosecutor tapped for Russia probe inquiry known as ‘aggressive, tireless and fair’
U.S. Attorney John Durham, the longtime lawman tapped to investigate the origins of the Russia investigation, is no stranger to high-stakes assignments that might make him unpopular in federal law enforcement circles. But his reputation as a hard-charging and apolitical prosecutor is what colleagues say has made him the go-to investigator for highly sensitive jobs. And looking into alleged misconduct within the FBI and other government agencies — surrounding the most politically explosive investigation since at least the Clinton era — could be his toughest assignment yet. Durham served as counsel to former U.S. Attorney for Connecticut Deirdre Daly when she was U.S. attorney and deputy U.S. attorney. Durham now holds the U.S. attorney position in Connecticut, but his profile rose this week after it emerged that Attorney General Bill Barr had assigned him to lead the investigation into “all intelligence collection activities” related to the Trump campaign during the 2016 presidential election, and any misconduct during the early stages of the FBI’s original Russia probe.

State Department official cited Steele in emails with Ohr after flagging credibility issues to FBI, docs reveal
Shortly after the 2016 presidential election, then-Deputy Assistant Secretary of State Kathleen Kavalec and Associate Deputy Attorney General Bruce Ohr discussed new allegations concerning the Trump campaign’s Russia connections that were sourced to British ex-spy Christopher Steele, according to documents made public Wednesday. The previous month, in October 2016, Kavalec had met with Steele and documented his political motivations in writing — particularly that he was “keen” to see his anti-Trump materials “come to light” prior to the election. Kavelec forwarded her written notes, in which she also pointed out that some of Steele’s claims were apparently false, to a senior FBI executive. Despite Kavalec’s concerns, the FBI used Steele’s information to obtain a Foreign Intelligence Surveillance Act (FISA) warrant targeting former Trump campaign adviser Carter Page just weeks later.

New York Mayor Bill de Blasio to announce 2020 White House bid on Thursday: source
New York City Mayor Bill de Blasio, widely known to have been pondering a White House run, is expected to announce his official entry into the crowded candidate field on Thursday, a source familiar with the situation told Fox News on Wednesday. De Blasio will make the announcement in a Thursday morning video followed by an appearance on ABC News’ “Good Morning America,” said the source, who requested anonymity. The mayor would be the 23rd Democrat vying for the Democratic presidential nomination, following Montana Gov. Steve Bullock, who announced his own candidacy on Tuesday. De Blasio has plans to visit a pair of early-voting states. He will travel to Iowa on Friday and South Carolina on Saturday, a spokesperson told Fox News. The mayor has been teasing an announcement this week about his decision. And he’s made several campaign-style trips to states expected to play key roles in the Democratic nominating process.

Pacific Gas & Electric power lines caused California’s ‘deadliest and most destructive wildfire’: officials
California authorities said Wednesday that power lines owned and operated by the Pacific Gas & Electric Corp. (PG&E) caused the state’s most destructive wildfire ever – one that killed 85 people and nearly destroyed an entire city. Lines owned by the San Francisco-based utility sparked the deadly, fast-moving Camp Fire on Nov. 8 in the Pulga area of Butte County, the state Department of Forestry and Fire Protection (Cal Fire) said in a news release. In total, the blaze burned 153,336 acres and destroyed in excess of 18,000 structures. The city of Paradise – population 27,000 — was nearly wiped out as residents evacuated and their homes and vehicles were engulfed in flames. Investigators also found a second nearby ignition site involving power lines owned by PG&E and vegetation that sparked another fire.

Alabama passes bill that would make almost all abortions illegal; House Dems target Trump lawyers

Alabama looks to outlaw nearly all abortions
Alabama’s state Senate passed a controversial bill on Tuesday that would outlaw nearly all abortions in the state and make performing one a felony unless the mother’s health is at risk. The bill will make the punishment for performing abortions up to 99 years or life in prison, although the woman who undergoes the procedure would not be subject to a See More felony charge. Democratic lawmakers pressed for amendments that would creation exceptions for instances of rape and incest but failed. The vote is expected to reignite a debate over Roe v. Wade, the 1973 Supreme Court decision that legalized abortion across the nation, and push Supreme Court justices to re-evaluate the laws. Meanwhile, a government report being released Wednesday says the nation’s birth rates for women in their teens and 20s reached record laws last year, leading to the fewest babies in 32 years.

House Democrats investigating Trump’s lawyers for possible obstruction
President Trump’s legal team slammed House Democrats on Tuesday evening after a report that the House Intelligence Committee has been investigating possible obstruction by Trump’s lawyers after the 2016 election. “Instead of addressing important intelligence needs, the House Intelligence Committee appears to seek a truly needless dispute,” Patrick Strawbridge, who represents attorney Jay Sekulow, told Fox News. The statement came in response to a New York Times article published Tuesday that said the committee, led by Rep. Adam Schiff, D-Calif., “is investigating whether lawyers tied to President Trump and his family helped obstruct the panel’s inquiry into Russian election interference by shaping false testimony.”

Biden has some other 2020 Dems hitting reset button
With Joe Biden surging to double-digit leads in polls as the frontrunner to face President Trump in 2020, some Democratic candidates are already reinventing their strategies and reintroducing themselves to the media. Rep. Ilhan Omar, D-Minn., defended her colleague, Rep. Rashida Tlaib, D-Mich., from criticism over controversial remarks about the Holocaust, insisting that the backlash is “designed” to “silence” Muslim voices. Appearing on MSNBC, Omar said that she and Tlaib, whom she referred to as “my sister,” have the “strength to endure any of the mischaracterization or efforts to distort and vilify and mischaracterize” their message. “I think we are seeing what happens when people really see these kind of attacks for what they are. It is designed to silence, sideline, and sort of almost eliminate [the] public voice of Muslims from the public discourse,” Omar told MSNBC host Chris Hayes.

Together we can bring attention to the social media censorship and hold these monopolies to the exemption they have hid behind.

It’s no longer a question of whether the Giant Social Media Companies – Google, Twitter, Facebook, Instagram, etc. – have become too powerful. They’ve matured to the point that they can actually affect what people see, read, listen to and even what See More they think. To make matters worse, they’ve decided that they will use these powers to change voting patterns and to Censor speech that opposes their political beliefs.

It’s time to stop them before all is lost. Harmeet Dhillon (Attorney Suing Google and Republican Party Official) has been on Tucker Carlson’s show frequently of late and she warns,

“Trump won’t win in 2020 and we will never win another election if we don’t stop this!”

One of the most likely ways for Congress to stop them would be to revise Section 230 of the Communications and Decency Act (CDA) that provides a special exemption from liability for content that is posted on their platforms. This exemption was initially extended to them because they claimed that their platforms would be a place for people from all points of view to post their ideas. Given their current Censorship actions, we all know that is no longer the case.

Consequently, the Social Media Platforms should be subjected to the possibility that they be responsible for all content that is posted on their sites since they selectively publish just as the New York Times or Washington Post do. In fairness, then, the Social Media Platforms should bear the same risk of liability for their content as other publishers.

This move would, of course, destroy their business model so they would be likely to change the Censorship tactics they use against Conservatives in order to avoid any changes to Section 230 of the CDA.

Alternatively, the threat of Antitrust Litigation is another avenue that may get their attention. The government should apply the same techniques against these Social Media Giants as they used to bring Microsoft to heel.

Our goal is to see our leaders pursue these remedies before it’s too late!

The 1996 law that made the web is in the crosshairs

Internet companies have long been shielded from legal responsibility for toxic user content by the Section 230 statute. Now that they’re huge, rich, and behaving badly, that gift could be taken away.

In the face of that toxic content’s intractability and the futility of the tech giants’ attempts to deal with it, it’s become a mainstream belief in Washington, D.C.–and a growing realization in Silicon Valley–that it’s no longer a question of whether to, but how to, regulate companies like Google, Twitter, and Facebook to hold them accountable for the content on their platforms. One of the most likely ways for Congress to do that would be to revise Section 230.

UNDERSTANDING SECTION 230

Section 230 remains a misunderstood part of the law. As Wyden explained it to me, the statute provides both a “shield” and a “sword” to internet companies. The “shield” protects tech companies from liability for harmful content posted on their platforms by users. To wit:

(c) (1) No provider or user of an interactive computer service shall be treated as the publisher or speaker of any information provided by another information content provider.

Specifically, it relieves web platform operators of liability when their users post content that violates state law by defaming another person or group, or painting someone or something in a false light, or publicly disclosing private facts. Section 230 does not protect tech companies from federal criminal liability or from intellectual property claims.

“Because content is posted on their platforms so rapidly there’s just no way they can possibly police everything,” Senator Wyden told me.

The “sword” refers to the 230’s “good samaritan” clause, which gives tech companies legal cover for choices they make when moderating user content. Before § 230, tech companies were hesitant to moderate content for fear of being branded “publishers” and thus made liable for toxic user content on their sites. Per the clause:

(c) (2) (a) No provider or user of an interactive computer service shall be held liable on account of any action voluntarily taken in good faith to restrict access to or availability of material that the provider or user considers to be obscene, lewd, lascivious, filthy, excessively violent, harassing, or otherwise objectionable, whether or not such material is constitutionally protected

“I wanted to make sure that internet companies could moderate their websites without getting clobbered by lawsuits,” Wyden said on the House floor back in March. “I think everybody can agree that’s a better scenario than the alternative, which means websites hiding their heads in the sand out of fear of being weighed down with liability.”

Many lawmakers, including Wyden, feel the tech giants have been slow to detect and remove harmful user content, that they’ve used the legal cover provided by § 230 to avoid taking active responsibility for user content on their platforms.

And by 2016 the harmful content wasn’t just hurting individuals or businesses, but whole societies. Social sites like YouTube became unwitting recruiting platforms for violent terrorist groups. Russian hackers weaponized Facebook to spread disinformation, which caused division and rancor among voters, and eroded confidence in the outcome of the 2016 U.S. presidential election.

As Wyden pointed out on the floor of the Senate in March, the tech giants have even profited from the toxic content.

“Section 230 means they [tech companies] are not required to fact-check or scrub every video, post, or tweet,” Wyden said. “But there have been far too many alarming examples of algorithms driving vile, hateful, or conspiratorial content to the top of the sites millions of people click onto every day –companies seeming to aid in the spread of this content as a direct function of their business models.”

And the harm may get a lot worse. Future bad actors may use machine learning, natural language, and computer vision technology to create convincing video or audio footage depicting a person doing or saying something provocative that they didn’t really do or say. Such “Deepfake” content, skillfully created and deployed with the right subject matter at the right time, could cause serious harm to individuals, or even calamitous damage to whole nations. Imagine a deep-faked president taking to Twitter to declare war on North Korea.

It’s a growing belief in Washington in 2018 that tech companies might become more focused on keeping such harmful user content off of their platforms if the legal protections provided in § 230 were taken away.

SHIELDING GIANTS

There’s a real question over whether Wyden’s “shield” still fits. Section 230 says web companies won’t be treated as publishers, but they look a lot more like publishers in 2018 than they did in 1996.

In 1996 websites and services often looked like digital versions of real-world things. Craigslist was essentially a digital version of the classifieds. Prodigy offered an internet on-ramp and some bulletin boards. GeoCities let “homesteaders” build pages that were organized (by content type) in “neighborhoods” or “cities.”

Over time the dominant business models changed. Many internet businesses and publishers came to rely on interactive advertising for income, a business model that relied on browser tracking and the collection of users’ personal data to target ads.

To increase engagement, internet companies began “personalizing” their sites so that each user would have a different and unique experience, tailor-made to their interests. Websites became highly curated experiences served up by algorithms. And the algorithms were fed by the personal data and browsing histories of users.

Facebook came along in 2004 and soon took user data collection to the next level. The company provided a free social network, but harvested users’ personal data to target ads to them on Facebook and elsewhere on the web. And the data was very good. Not only could Facebook capture all kinds of data about a user’s tastes, but it could capture the user’s friends’ tastes too. This was catnip to advertisers because the social data proved to be a powerful indicator of what sorts of ads the user might click on.

Facebook also leveraged its copious user data, including that on the user’s clicks, likes, and shares, to inform the complex algorithms that curate the content in users’ news feeds. It began showing users the posts, news, and other content that the user–based on their personal tastes–was most likely to respond to. This put more attention-grabbing stuff in front of its users’ eyeballs, which pumped up engagement and created more opportunities to show ads.

This sounds a lot like the work of a publisher. “Our goal is to build the perfect personalized newspaper for every person in the world,” Facebook CEO Mark Zuckerberg said in 2014.

But Facebook has always been quick to insist that it’s not a publisher, just a neutral technology platform. There’s a very good reason for that: Publishers are liable for the content
